Fashion & Beauty Giveaway – Terms & Conditions (Australia)

These Terms & Conditions (T&Cs) govern the Fashion & Beauty Giveaway (Promotion). By participating, you agree to these T&Cs.


Promoters

Sephora Australia Pty Ltd (ABN 96 058 696 549) of Level 11, 32 Martin Place, Sydney NSW 2000 (Sephora Australia) and
ANNA QUAN Pty Ltd (ABN 11 152 792 188) of Suite 1.06, 200 Euston Road, Alexandria NSW 2015 (ANNA QUAN).
Together, the “Promoters.”


1. Promotion Overview & Key Dates

  • Platform: Instagram only – public collaborative Promotion Post that appears on both @sephoraaus and @annaquanlabel Instagram accounts (Promotion Post).

  • Opens: When the Promotion Post is first published.

  • Closes: 11:59 pm AEST Monday, 21 July 2025 (Close Date). Instagram timestamps apply. Late comments are not accepted.

  • Draw: 3:00 pm AEST Tuesday, 22 July 2025 at Sephora Australia, Level 11, 32 Martin Place, Sydney NSW.

  • Unclaimed Prize Draw (if required): 5:00 pm AEST Friday, 29 August 2025 at the same address.

AEST = Australian Eastern Standard Time (UTC+10). If Instagram displays your local time, AEST prevails.


2. Eligibility

Entry is open to individuals who:

  1. Are Australian residents;

  2. Are 18 years or over at the time of entry; and

  3. Hold a personal Instagram account capable of receiving Direct Messages (DMs) from @sephoraaus.

Tagged Friend Age Requirement: Each tagged friend must also be 18+ and (where reasonably possible) an Australian resident. You must have the tagged friend’s permission to tag them.

Ineligible: Employees (and their immediate families) of the Promoters, related bodies corporate, associated agencies and prize suppliers.


3. How to Enter

During the Promotion Period:

  1. Follow @sephoraaus and @annaquanlabel on Instagram.

  2. Like the Promotion Post.

  3. Comment on the Promotion Post tagging exactly one (1) Instagram friend. One comment = one entry.

    • Unlimited eligible comments/entries allowed.

    • If more than one handle appears in a single comment, the Promoters may (at their discretion) treat the comment as one entry referencing the first valid handle, or deem the comment invalid.

  4. (Optional bonus) Repost the Promotion Post to your Instagram Story and tag both @sephoraaus & @annaquanlabel. See Clause 4.

Private accounts: Still eligible; keep screenshots showing follows and Story reposts in case verification is required. No automation: Bots, macros, scripts, bulk‑tag tools, or third‑party competition aggregators are prohibited. Such entries may be void.


4. Bonus Story Entries

Each qualifying Instagram Story in which you repost the Promotion Post and tag both @sephoraaus & @annaquanlabel earns +1 additional entry. Multiple Stories are permitted during the Promotion Period. The Promoters may cap, disregard or disqualify Story activity that appears to be spam, abusive or technically unverifiable.


5. Valid Entries & Follower Check

A Valid Entry is an entry that complies with Clauses 3 & 4 and, at the Close Date:

  • The entrant’s Instagram account follows @sephoraaus and @annaquanlabel; and

  • At least one tagged friend account (18+) follows @sephoraaus and @annaquanlabel.

Entries that are incomplete, indecipherable, offensive, infringing, fraudulent, automated, bulk‑generated or otherwise contrary to these T&Cs may be disqualified.

 


6. Prize Overview

One (1) winner will receive both prize components below (total approx. AUD $1,300 RRP – GST inclusive where applicable):

  • AUD $500 ANNA QUAN Wardrobe Credit (see Clause 7).

  • AUD $800 MAKE UP FOR EVER Product Bundle including best sellers and 6 new Artist Color Crayons (expected August 2025 launch; availability permitting – see Clause 8).

Prizes are not transferable or exchangeable and cannot be taken as cash, except as required by law.


7. ANNA QUAN Wardrobe Credit Conditions

7.1 Fulfilled as store credit with no expiry applied to the verified winner’s ANNA QUAN customer account. Winner must hold (or create) an ANNA QUAN account and be logged in to redeem online.

7.2 At the winner’s request, the Promoters may instead issue an ANNA QUAN gift card of equivalent value.

7.3 Store credit / gift card is not redeemable for cash (except where required by law).

7.4 Standard ANNA QUAN consumer returns policy and rights under the Australian Consumer Law (ACL) apply to any redeemed merchandise.


8. MAKE UP FOR EVER Bundle Conditions

8.1 Supplied by Sephora Australia (or an authorised distributor) and shipped to the verified Australian residential address provided by the winner.

8.2 Product mix is subject to stock and launch timing. If any advertised item (including the new Artist Color Crayons) is unavailable, Sephora may substitute an item of equal or greater value (GST inclusive where applicable) at its discretion. Shade preferences will be accommodated where reasonably possible but are not guaranteed.

8.3 Standard Sephora Australia consumer returns policy and ACL rights apply to prize products.


9. Draw, Notification & Response

9.1 Draw: A random electronic draw of all Valid Entries will be conducted by Sephora Australia at 3:00 pm AEST Tuesday, 22 July 2025 at the address in the Promoter details. Reserve entries may be drawn.

9.2 Notification: The provisional winner will be notified by Instagram DM from @sephoraaus within 2 business days of the draw. Entrants should check their DM “message requests” folders. The Promoters are not responsible for misdirected or filtered messages.

9.3 Response Deadline: The provisional winner must respond to the DM within 2 business days of the DM timestamp and supply the verification information described in Clause 10. Failure to respond or provide complete information within time may result in prize forfeiture and selection of a reserve/redraw winner.

9.4 Publication: Once verified, the winner’s Instagram handle (and, if consented, first name & State/Territory) will be announced via @sephoraaus Story and/or a comment on the Promotion Post within 5 business days.


10. Age, Residency & Address Verification

To be confirmed as the winner and claim the prize, the provisional winner must, within 2 business days of request, provide acceptable proof that they are 18+ and an Australian resident with a current Australian residential address.

Primary proof (provide ONE):

  • Current Australian driver licence; or

  • Current State/Territory government photo ID / proof‑of‑age card.

The ID must show the winner’s name and Australian residential address. If the address is not current or not shown, the Promoters may request supplementary document(s) dated within the last 3 months showing the winner’s name and current Australian residential address (e.g., utility bill, council rates, lease agreement, bank/credit card statement, government correspondence, electoral enrolment, ATO notice).

The Promoters may also require the entrant to confirm that the tagged friend was 18+ at the time of entry and following both accounts at the Close Date.

The prize will not be awarded until verification is complete. Failure to provide acceptable proof within the required time will result in disqualification and selection of a reserve/redraw winner.


11. Unclaimed Prize Draw

If the prize is not awarded (ineligible, uncontactable, or unverified winner) by 5:00 pm AEST Friday, 29 August 2025, Sephora Australia will conduct a redraw from remaining Valid Entries (or use reserve entries) at its Sydney office. Redraw winner(s) will be notified by DM within 2 business days and must complete verification under Clause 10. Publication will occur as per Clause 9.4.


12. Privacy & Data Handling

Personal information is collected by Sephora Australia (and shared with ANNA QUAN) to administer the Promotion (verify eligibility, contact the winner, fulfil the prize) and, if you opt in, to send marketing communications from one or both Promoters.

Personal information is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, Sephora Australia’s Privacy Policy (sephora.com.au) and ANNA QUAN’s Privacy Policy (annaquan.com.au). Verification documents are used solely to confirm eligibility and will be securely stored, redacted and/or deleted when no longer required for legal, audit or dispute resolution purposes.


13. General Conditions

13.1 The Promoters may verify entries and entrants at any time. Failure to produce proof as reasonably requested may result in disqualification.
13.2 The Promoters may disqualify any entry that is incomplete, indecipherable, offensive, infringing, fraudulent, automated, bulk‑generated, submitted via multiple/alias accounts, or otherwise contrary to these T&Cs.
13.3 If the Promotion is interfered with in any way (incl. technical malfunction, fraud, platform changes, unauthorised intervention) or is unable to run as planned, the Promoters may, subject to regulatory approval, cancel, terminate, modify or suspend the Promotion.


14. Liability

Nothing in these T&Cs restricts, excludes or modifies any statutory consumer rights, including those under the Australian Consumer Law. Subject to those rights, the Promoters (and their related bodies corporate, officers, employees and agents) are not liable for any loss, damage, personal injury or death in connection with the Promotion or any prize except to the extent caused by their negligence or wilful misconduct. The winner is responsible for any tax implications arising from the prize; independent financial advice is recommended.


15. Instagram Disclaimer

This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Meta. You understand that you are providing your information to the Promoters and not to Instagram. By entering, you completely release Instagram from all liability arising in connection with the Promotion.


16. Regulatory & Permit Information

Approx. total prize pool AUD $1,300 (GST inclusive where applicable). As at July 2025, this value is below the current trade promotion permit thresholds in NSW, ACT and SA; however, thresholds can change. The Promoters will review applicable State/Territory requirements before launch and obtain any required authorisations.


17. Governing Law

These T&Cs are governed by the laws of New South Wales, Australia. Entrants submit to the non‑exclusive jurisdiction of the courts of NSW. Entrants in other Australian jurisdictions retain the benefit of any mandatory consumer protections that apply.
